Patient dies after operation, is surgeon to blame like family think..?

In my opinion the Doctor cannot be held liable for the baby's death,especially if the parents were made aware of the possibility and it has been my experience that patients or legal guardians of patients have to Sign some sort of doent that unless the doctor was grossly negligent he is exonerated of any liability for the death of a patient.
